Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant is entitled to a stay of execution of the decree pending appeal.
  2. 2 Whether the application is competent in the absence of an appeal against the judgment and decree.
  3. 3 Whether a negative order of dismissal is capable of being stayed.

Ratio Decidendi

The court found that the applicant had not appealed against the decree and judgment whose execution was sought to be stayed. The application for stay of execution was therefore incompetent, as a stay can only be granted where there is an appeal against the order or judgment in question. Furthermore, the order issued on 22nd September 2023 was a negative order of dismissal, which is not capable of execution and thus cannot be stayed. The application was dismissed as a non-starter with no orders as to costs.
