Ratio Decidendi

The Court found that the applicant failed to demonstrate that the alleged underpayment was a new and important matter that could not have been discovered with due diligence at the time of the original claim. The terms and conditions of service were available and should have been reviewed by the applicant, who is the grievant's union. The Court also found that the award was not conditional upon the decision of the Retirement Benefits Authority, and that the application for review was brought after an inordinate delay of almost seven years. Consequently, the application for review lacked merit and was dismissed with costs.
