Ratio Decidendi

The court found that while the application for stay of execution was filed more than two months after judgment, the applicants had demonstrated that an appeal had been filed. Although the applicants did not provide detailed particulars of substantial loss, the respondent did not indicate ability to refund the decretal sum if the appeal succeeded. To prevent the appeal from being rendered nugatory, the court exercised its discretion to grant a conditional stay of execution, requiring the entire decretal sum to be deposited in an interest-earning joint account of the parties' advocates within 60 days, failing which execution could proceed. Costs were ordered to abide the outcome of the appeal.
