The court found that the applicant failed to demonstrate substantial loss that would result if stay of execution was not granted, as required by Order 42 Rule 6(2) of the Civil Procedure Rules. The applicant did not provide evidence that the respondents would be unable to refund the decretal sum if the appeal succeeded, nor did he offer security for due performance of the decree.
