Ratio Decidendi

The court found that there was insufficient evidence to show that the respondents' advocates were properly served with the hearing notice for the application for judgment. The applicant did not controvert the respondents' claim that the person who acknowledged service was not their employee. Furthermore, the respondents had, in fact, requested reasons for taxation within the time allowed, as evidenced by a letter acknowledged by the court. Had this information been presented earlier, judgment would likely not have been entered. Therefore, the default judgment was set aside ex debito justitiae due to lack of proper service and compliance with the court's directions on taxation.
