Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time and Stay of Execution

  1. 1 Whether leave should be granted to file an appeal out of time.
  2. 2 Whether the applicant is entitled to an order for stay of execution of the judgment of the lower court pending appeal.
  3. 3 Who should bear the costs of the application.

Ratio Decidendi

The court found that the applicant had not demonstrated good and sufficient cause for failing to file the appeal within the statutory thirty-day period, as required by Section 79G of the Civil Procedure Act. Although the applicant claimed not to have received the judgment and proceedings, the supporting affidavit confirmed that the judgment was delivered electronically via email on February 7, 2022. The court was not convinced by the applicant's explanation for the delay and, consequently, found no basis to consider the request for stay of execution. The application was therefore dismissed for lack of merit, with costs awarded to the respondents.
