The tribunal found the landlord’s valuation report more persuasive as it relied on comparables within the same locality and with similar facilities, unlike the tenant’s report which used less relevant comparables. The tribunal also considered the tenancy agreement, which provided for biennial rent increases, and determined that as of 2021, the rent should have been Kshs 35,000/-. The proposed increment to Kshs 100,000/- was deemed exaggerated and unreasonable.
