Procedural Posture

Miscellaneous Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant is entitled to stay of execution of the judgment delivered on 28/2/2023 pending appeal.
  2. 2 Whether the applicant has satisfied the legal requirements for grant of stay of execution under Order 42 Rule 6 of the Civil Procedure Rules.

Ratio Decidendi

The court found that the applicant had not filed an appeal against the judgment delivered on 28/2/2023, nor had he applied for extension of time to file such an appeal, despite having obtained a copy of the judgment. Without an appeal on record, the court held that it could not invoke Order 42 Rule 6 of the Civil Procedure Rules to grant a stay of execution. The applicant's failure to comply with the statutory requirements for lodging an appeal within time, or to seek enlargement of time, was fatal to his application. Consequently, the court declined to grant the orders sought for stay of execution.

Court Disposition

Application for stay of execution dismissed.
