The court found that although there was an oral sale transaction between Rama Matano and the defendant (or her late husband), the transaction was not completed and was invalid for lack of consent from the co-owner, Anne Kimani. The absence of a written agreement did not, in itself, invalidate the transaction because section 3(3) of the Law of Contract Act was not yet in force at the time. However, since the property was jointly owned, Rama could not unilaterally sell or transfer any interest in the property to the defendant without Anne Kimani's consent.
