The court found that the applicants failed to provide a satisfactory explanation for the delay in filing the appeal, as the application was brought approximately four months after judgment without a certificate of delay or sufficient cause. The explanation that the delay was due to inability to obtain the judgment was not substantiated. Consequently, the prayer for leave to appeal out of time was dismissed. Since leave to appeal out of time was not granted, the prayer for stay of execution was rendered moot and could not be granted. The application was therefore dismissed in its entirety with costs to the respondents.
