Ratio Decidendi

The High Court found that the trial magistrate correctly determined he lacked jurisdiction to entertain the dispute, as section 18 of the Societies Act requires such disputes to be referred first to the Registrar of Societies. However, the magistrate erred by proceeding to dismiss the appellant's applications and allow the respondents' application after finding a lack of jurisdiction. The proper course was to down tools and dismiss the suit for want of jurisdiction. The High Court therefore allowed the appeal, set aside the trial court's ruling, and dismissed the original suit for want of jurisdiction, with costs to the respondents both in the lower court and on appeal.
