The court found that the plaintiff had not remitted the payment required by the previous order, and that repeated applications could amount to an abuse of process. However, in view of the possibility that the Receiver Managers' takeover could frustrate the plaintiff's efforts to settle the debt through asset sales, the court exercised its discretion to grant a conditional injunction.
