The court held that the application to join the intended 3rd parties and to review and set aside the judgment was not tenable because the suit had already been concluded and an appeal was pending before a higher court. Under the functus officio doctrine, the court had exhausted its jurisdiction over the matter and could not reopen the proceedings or admit new parties. The only exception to functus officio is the power to review, which is limited and does not extend to the circumstances presented.
