Procedural Posture

Civil Appeal / Ruling on Stay Application Pending Appeal

  1. 1 Whether the applicant is entitled to a stay of execution of the judgment and decree pending appeal.
  2. 2 Whether the application was filed without unreasonable delay.
  3. 3 Whether the applicant will suffer substantial loss if stay is not granted.

Ratio Decidendi

The court found that the application for stay of execution was filed without unreasonable delay, as it was made within approximately one month of the judgment. The court determined that the applicant would suffer substantial loss if stay was not granted because the respondent had not demonstrated financial means to refund the decretal sum should the appeal succeed. The applicant's offer to deposit the decretal amount in a joint interest earning account was deemed adequate security. Accordingly, the court granted a stay of execution of the judgment and decree pending the determination of the appeal, conditional upon the applicant depositing the decretal sum within 60 days.

Court Disposition

Application for stay of execution granted, subject to conditions.
