The court held that the computation of time for filing and serving the Notice of Appeal and Record of Appeal must exclude public holidays and weekends as provided under Rule 3(b) of the Court of Appeal Rules. Since the 14-day period from the date of the ruling expired on Labour Day (a public holiday), and the following days were a Saturday and Sunday, the next working day was 4th May 2015. The Notice of Appeal was served on that day, and the Record of Appeal was filed and served within the period granted by the court. Therefore, both documents were filed and served within time, and the application to strike them out lacked merit.
