The court found that the applicant had demonstrated a likelihood of suffering substantial loss if the stay was not granted, particularly as the substratum of the appeal (the suit properties) could be disposed of or transferred, rendering the appeal nugatory. The application was filed without unreasonable delay, and although the applicant had not yet provided security, he expressed willingness to do so. The court exercised its discretion to grant stay of execution pending appeal, conditional upon the applicant depositing KES 200,000 as security for costs within 30 days, failing which the stay would lapse. Each party was ordered to bear its own costs.
