Ratio Decidendi

The court found that the petitioner had established, to the required standard, that the 1st respondent committed adultery with the 2nd respondent and treated the petitioner with cruelty. The evidence was uncontroverted as the respondents did not appear or contest the petition. There was no evidence of collusion or condonation. The marriage was deemed to have irretrievably broken down. The court therefore ordered the dissolution of the marriage, granted joint custody of the child with physical custody to the petitioner, and left issues of access and maintenance to be determined by the Children’s Court if necessary. No order as to costs was made.
