Procedural Posture

Miscellaneous Application / Ruling on Application for Stay of Execution and Extension of Time to Appeal

  1. 1 Whether the applicant has met the threshold for grant of stay of execution pending appeal.
  2. 2 Whether the applicant has provided sufficient cause for extension of time to file an appeal out of time.

Ratio Decidendi

The court found that the applicant failed to provide a satisfactory and reasonable explanation for the delay in filing the appeal, as no evidence was tendered to support the claim of a system upgrade or misplacement of documents. The delay of approximately 16 days was deemed inordinate and unexplained. The applicant also failed to demonstrate that it would suffer substantial loss if stay was not granted, as there was no evidence that the respondents would be unable to refund the decretal amount if the appeal succeeded. Although the applicant expressed willingness to provide security, the failure to meet the first two conditions for stay of execution rendered the application unsustainable....
