The High Court found that the Tongaren Land Disputes Tribunal lacked jurisdiction under section 3(1) of the Land Disputes Tribunal Act No.18 of 1990 to determine matters relating to title to land. The Tribunal's award, as well as its confirmation by the Western Province Land Disputes Tribunal and subsequent adoption by the Magistrate's Court, were therefore nullities. The court relied on established legal principles that any decision made without jurisdiction is void ab initio and cannot be validated by subsequent court orders.
