Ratio Decidendi

The court found that the applicant had not demonstrated substantial or prejudicial loss as required under Order 42 Rule 6(2)(a) of the Civil Procedure Rules, since the only reason advanced was an alleged debt owed by the respondent in unrelated matters, which did not amount to substantial loss. However, in balancing the interests of both parties and in light of the respondent's concession, the court exercised its discretion to grant an extension of 60 days for compliance with the order of 4th December 2012, subject to the applicant depositing Kshs. 269,000 in a joint interest-earning account held by the advocates for both parties. No order as to costs was made.
