The High Court held that it was functus officio after delivering its final judgment on 23/9/2019 and therefore lacked jurisdiction to entertain an application for injunction pending appeal. The court found that Order 40 of the Civil Procedure Rules only empowers the court to grant interim injunctions pending the determination of a suit, not after judgment has been delivered. The proper forum for seeking an injunction pending appeal in this context is the Court of Appeal. As such, the application was dismissed for want of merit and jurisdiction.
