Ratio Decidendi

The court found that the application was unopposed and that the applicant had demonstrated sufficient grounds for the extension of the stay of proceedings and for the review and setting aside of the previous order transferring the suit to Limuru Magistrate's Court Civil Division. In the interests of justice and convenience, the court exercised its discretion to substitute the previous order with one transferring the suit to Kiambu Magistrate's Court Civil Division or any other suitable court station for hearing and disposal. Costs were ordered to be in the cause.
