The appeal was determined on the basis that the respondents failed to provide adequate evidence to prove that the deceased was survived by a dependant daughter or that any of the listed dependants were actually dependent on the deceased. The age of the alleged daughter was not disclosed, and no birth certificate or other conclusive proof of dependency was produced. The trial court's reliance on a Chief's letter was insufficient in the absence of further evidence. As dependency is a matter of fact requiring proof, and the global approach to damages still requires such proof, the award for loss of dependency could not be sustained.
