The court found that the applicant provided a satisfactory explanation for the delay in filing the appeal, supported by evidence of a downturn in the Judiciary internet system and uncontroverted correspondence between the applicant and its advocates. The respondents did not file a replying affidavit to challenge the applicant's factual assertions. The delay was minimal, being only about a week beyond the prescribed period. In the absence of any challenge to the applicant's explanation and considering the short duration of the delay, the court exercised its discretion in favour of the applicant and granted an extension of 30 days from the date of the ruling for filing the appeal.
