Ratio Decidendi

The Court of Appeal held that the appellants' Originating Summons was fundamentally flawed because it sought rectification of the land register under section 143 of the Registered Land Act, a matter expressly excluded from being brought by Originating Summons under Order XXXVI rule 3F of the Civil Procedure Rules. The rectification of the register was a prerequisite to the appellants' claim for adverse possession, and without it, their claim was unsustainable. Since the Originating Summons was outside the scope of Order XXXVI, the High Court had no discretion to convert the proceedings to a plaint under rule 10. The inclusion of the excluded prayers rendered the entire suit incompetent...
