The Employment and Labour Relations Court (ELRC) has jurisdiction to enforce an award made by the Director under the Work Injury Benefits Act (WIBA) where the award is not challenged or appealed and the employer fails, refuses, or neglects to settle the award. The court reasoned that such an award, once unchallenged, becomes a debt due and payable arising from an employment relationship, and the ELRC's exclusive jurisdiction under Section 12 of the Employment and Labour Relations Court Act and Section 87 of the Employment Act extends to such enforcement.
