The Supreme Court held that its appellate jurisdiction under article 163(4)(a) of the Constitution is limited to appeals from the Court of Appeal where the issues in contestation revolved around the interpretation or application of the Constitution, and only by parties who were aggrieved and participated in the lower courts. The Court found that the Law Society of Kenya, not being a party in the High Court or Court of Appeal, lacked locus standi to file the appeal.
