Ratio Decidendi

The court found that the suit was res judicata because the subject matter (LR 61/16) and the parties (or those claiming through them) were the same as in the earlier Thika CMCC No. 36 of 2011, which was decided on the merits. The plaintiffs, although not parties to the previous suit, claimed through the 1st defendant, who had already been found to have no proprietary interest in the land. Therefore, the plaintiffs could not acquire any rights from the 1st defendant. Additionally, the plaintiffs failed to produce any written agreements or evidence of purchase from the 2nd – 7th defendants as required by Section 3(3) of the Law of Contract Act and Section 38 of the Land Act.
