Ratio Decidendi

The court found that the transfer of Title No. Mbeti/Gachoka/2651 to the 2nd Respondent was irregular and illegal as it was effected while a caution registered by the Applicant was still subsisting and had not been removed in accordance with the Land Registration Act. The 2nd Respondent could not be considered an innocent purchaser for value without notice, as the caution was clearly entered in the register and indicated the Applicant's claim. The lack of a stay of execution did not justify bypassing statutory requirements for removal of the caution. The court held that the Respondents and the Interested Party violated sections 72 and 73 of the Act, rendering the transfer voidable....
