Procedural Posture

Constitutional Petition / Ruling on Jurisdiction

  1. 1 Whether the High Court has jurisdiction to hear and determine disputes relating to compulsory acquisition of community land and environmental degradation.
  2. 2 Whether the petitioners are entitled to compensation for compulsory acquisition and extraction of materials from their land without compensation.
  3. 3 Whether the proper forum for the dispute is the Environment and Land Court.

Ratio Decidendi

The court found that the dispute concerns compulsory acquisition of land and environmental degradation, both of which fall squarely within the jurisdiction of the Environment and Land Court as provided under section 13(1) and (2) of the Environment and Land Court Act. The High Court, therefore, lacks jurisdiction to entertain the petition. The issue of jurisdiction, being fundamental, can be raised by the court suo motu. Consequently, the court declined to exercise jurisdiction and ordered the transfer of the petition to the Environment and Land Court for hearing and determination, in line with the efficient disposal of judicial business and the proper use of judicial resources.

Court Disposition

Petition transferred to the Environment and Land Court for hearing and determination due to lack of jurisdiction.
