Ratio Decidendi

The court found that the applicants' application for leave to appeal was filed within the time stipulated by the superior court, and therefore extension of time was unnecessary. However, if this was incorrect, the court extended the time for filing the application to the date it was actually filed. The court was satisfied that the intended appeal was not frivolous and that it was just to allow the applicants to appeal. Leave to appeal was granted, and the time for filing a notice of appeal was extended by 14 days from the date of the ruling. The applicants were also ordered to pay the respondent's expenses related to the application.
