Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appellant's summary dismissal was procedurally and substantively fair under the Employment Act.
  2. 2 Whether the appellant was entitled to terminal dues including notice pay, service pay, leave pay, and compensation.
  3. 3 Whether the respondent was justified in deducting damages from the appellant's terminal dues for negligence.

Ratio Decidendi

The court found that while the appellant was liable for negligence and caused damage to the respondent's property, the respondent failed to comply with the mandatory procedural requirements under Sections 35 and 41 of the Employment Act before effecting summary dismissal. There was no evidence of a proper disciplinary hearing or notice allowing the appellant to respond to the allegations. As a result, the termination was procedurally unfair. However, the appellant's poor work record and established negligence justified the deduction of Ksh. 100,000 from his terminal dues. The appellant was entitled to notice pay, service pay, and leave pay, but not to compensation or other claimed dues....

Court Disposition

Appeal partially allowed; summary dismissal found procedurally unfair but compensation denied; terminal dues awarded subject to deduction for damages; each party to bear own costs.

Orders

  • The respondent shall pay the appellant notice pay of Ksh. 16,000, leave pay of Ksh. 26,000, and service pay of Ksh. 16,000, less Ksh. 100,000 owed to the respondent for damages.
  • No compensation for unfair termination is awarded.
