The court found that the applicant was not notified of the judgment delivery and only became aware of it upon receipt of the draft decree and certificate of costs from the 1st respondent's advocate. The application for extension of time was filed promptly thereafter. The court was satisfied that sufficient cause had been shown for the delay and granted leave to appeal out of time. On the issue of stay of execution, the court held that although stay is not ordinarily granted for money decrees, the applicant had demonstrated apprehension regarding the respondent's ability to refund the decretal sum if the appeal succeeded, and the respondent had not provided adequate evidence of means....
