Ratio Decidendi

The court held that while failure to join the Returning Officer as a party does not fatally affect the petition due to representation by the Commission and the constitutional imperative to avoid undue technicalities, the failure by the petitioner to deposit security for costs within the statutory period is a substantive defect. Section 78 of the Elections Act is clear that deposit of security for costs is mandatory and jurisdictional; non-compliance deprives the court of jurisdiction to hear the petition further. Since the petitioner had not deposited the required security for costs more than 10 days after filing, the petition was struck out and costs awarded to the respondents.
