Ratio Decidendi

The court found that although the Respondent had valid and fair reasons to terminate the Claimant due to his poor record of service and multiple warning letters, the termination process did not comply with the procedural fairness requirements under Section 41 of the Employment Act, 2007. The Claimant was not subjected to a disciplinary hearing or given an opportunity to respond to the allegations against him. As a result, the termination was deemed unlawful and unfair. However, the court also found that the Claimant largely contributed to his termination and therefore limited compensation to one month's salary. The court dismissed the claim for additional benefits due to lack of proof.
