Procedural Posture

Land and Environment Case / Ruling on Post Judgment Eviction and Demolition Application

  1. 1 Whether the plaintiff is entitled to eviction and demolition orders against the defendants as unlawful occupants of LR NO BUNGOMA/NAITIRI/1907.
  2. 2 Whether the court should grant police assistance for enforcement of the orders.

Ratio Decidendi

The court found that the plaintiff is the registered proprietor of the suit land and that judgment had already been entered in his favour, granting him the reliefs sought in the plaint. The defendants, having been served with the decree, failed to comply or file any appeal. Their continued occupation is therefore unlawful. Section 152B of the Land Act 2012 mandates eviction of unlawful occupants. The application for eviction, demolition, and police assistance was unopposed and justified by the defendants' persistent non-compliance. The court allowed the application as prayed, except for costs.

Court Disposition

Application allowed. Eviction, demolition, and police assistance orders granted.

Orders

  • An order of demolition of the defendants' buildings and all structures illegally erected on LR NO BUNGOMA/NAITIRI/1907 is issued.
  • An order for eviction of the defendants from LR NO BUNGOMA/NAITIRI/1907 is issued.
