Procedural Posture

Injunction Application / Application for Injunction Pending Appeal

  1. 1 Whether the applicants have demonstrated an arguable appeal that may be rendered nugatory absent stay.
  2. 2 Whether the statutory notice of sale was properly served on the applicants.
  3. 3 Whether the refusal of an injunction by the High Court is a negative order capable of being stayed.

Ratio Decidendi

The Court found that the applicants failed to demonstrate an arguable appeal that would be rendered nugatory if stay was not granted. The statutory notice of sale was served using the 2nd applicant's postal address, and the 2nd applicant did not deny indebtedness, only alleging irregularity in the sale. There was no evidence that the respondent, a financial institution, would be unable to refund any sums recovered. Furthermore, the application sought to stay a negative order (refusal of an injunction), which is not capable of being stayed. Consequently, the application for injunction pending appeal was disallowed.
