The appellant's agent failed to exercise due diligence in ascertaining the respondent's eligibility for such a policy and only later discovered the respondent did not qualify. By then, the respondent had already paid Kshs.1,200,000 in premiums. The agent subsequently presented the respondent with an investment policy without proper explanation or disclosure of the change in the nature of the policy.
