The Court of Appeal held that, although there is a divergence of opinion in the High Court regarding whether section 6 of the Land Control Act precludes enforcement of an equitable trust arising from payment of the purchase price for shares in a land-owning company, the High Court judge did not err in refusing to set aside the temporary injunction at the interlocutory stage. The court found that the issues raised were weighty and should be determined at trial, not on an interlocutory application.
