The administrators, upon full repayment of the loan, are entitled to have the charge discharged as part of their duty to consolidate and liquidate estate liabilities before confirmation of grant. The Law of Succession Act and the Probate and Administration Rules do not require confirmation of grant as a precondition for discharge of a charge over estate property. The discharge of liabilities is a necessary step before the net estate can be ascertained and distributed.
