Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant is entitled to arrears of provident fund contributions for the period 2005 to 2015.
  2. 2 Whether the claimant is entitled to NSSF arrears from the respondent.
  3. 3 Whether the claimant is entitled to gratuity and annual bonuses as claimed.

Ratio Decidendi

The court found that the claimant acquiesced to the stoppage of provident fund contributions by making her own payments for over ten years without protest, and thus could not claim arrears from the respondent. The claim for NSSF arrears was dismissed as such contributions are statutory and recoverable only by the NSSF Board, not the employee. Gratuity and annual bonus claims were dismissed for lack of contractual or statutory basis, as neither the employment contract nor the law provided for them. The only relief granted was the statutory entitlement to a certificate of service under Section 51 of the Employment Act. All other claims were dismissed for want of merit and evidentiary support.

Court Disposition

Claim dismissed except for certificate of service.

Orders
