Ratio Decidendi

The court found that the plaintiff did not receive the two cheques from the defendant as a result of the garnishee proceedings but rather through direct payment. The garnishee nisi order against KCB was never made absolute, and thus KCB was not under a court obligation to pay the plaintiff under the garnishee order. Any alleged wrongdoing by KCB in reversing the cheques was a matter for a separate suit and not for determination within the garnishee proceedings. Consequently, the plaintiff was not entitled to the costs of the garnishee proceedings against KCB, as the event that would justify such costs did not occur within the context of the garnishee process.
