Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant has met the conditions for the grant of a stay of execution pending appeal.

Ratio Decidendi

The court found that the applicant demonstrated she would suffer substantial loss if evicted from her matrimonial home before the appeal is heard, as this would destroy the substratum of her appeal and render it nugatory. The application was filed promptly, satisfying the requirement of timeliness. The applicant's willingness to abide by any reasonable condition as to security for costs was deemed sufficient demonstration of readiness to furnish security. The court held that all three conditions under Order 42 Rule 6 of the Civil Procedure Rules were met and granted a stay of execution on condition that the applicant deposits Kshs. 100,000 in court within 30 days as security for costs.

Court Disposition

Application for stay of execution pending appeal granted, subject to deposit of security.

Orders

  • A stay of execution of the decree issued vide the judgment delivered on February 23, 2022 is granted pending the hearing and determination of the intended appeal, on condition that the applicant deposits Kshs. 100,000 in court within 30 days as security for costs.
  • If the said amount is not deposited in court within the stipulated time, the order for stay shall automatically lapse.
