The court further found that although the application was filed within reasonable time, the applicant did not offer any security for the due performance of the decree as required by law. The court also clarified that it was not functus officio and had jurisdiction to entertain the application. On these grounds, the application for stay of execution pending appeal was dismissed with costs.
