Ratio Decidendi

The court found that Section 47(2) of the Land Registration Act prohibits minors from dealing with land unless a court order authorizes the transaction. The Applicants, being a mother and her minor son, sought to sell jointly owned property to purchase a more valuable property, with the proceeds to be used for the minor's benefit. The court was satisfied that the transaction did not prejudice the minor's interest and that the statutory bar could be overcome by judicial sanction. Accordingly, the court granted the orders sought, allowing the sale and directing the District Land Registrar to register the transfer in favour of the purchaser.
