The High Court determined that, while it has original and supervisory jurisdiction under the Constitution to enforce fundamental rights and review decisions of subordinate tribunals, the Political Parties Disputes Tribunal is vested with first instance jurisdiction over disputes between members of political parties and their parties by virtue of section 40 of the Political Parties Act. The High Court's jurisdiction is not ousted by statute, but parties must exhaust the remedies provided by the Tribunal before approaching the High Court.
