Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant's termination was unfair and unjustified under the Employment Act, 2007.
  2. 2 Whether the respondent followed due process in terminating the claimant's employment.
  3. 3 Whether the claimant is entitled to compensation and terminal dues.

Ratio Decidendi

The court found that while the respondent had a valid reason to terminate the claimant's employment due to absence without approved leave, the respondent failed to follow the mandatory procedural requirements under Section 41 of the Employment Act, 2007. There was no evidence that the claimant was given an opportunity to be heard or to defend himself before termination. The absence of a fair hearing rendered the termination unfair and unjustified under Section 45(2) of the Act. The court therefore held that the claimant was entitled to compensation for unfair termination and payment of terminal dues as admitted by the respondent and evidenced in the claimant's documentation.

Court Disposition

Claim allowed in part; claimant awarded compensation and terminal dues.

Orders

  • Respondent to pay claimant KES 183,744 as compensation and terminal dues.
  • Respondent to pay costs of the suit and interest at court rates from the date of judgment.
