The court found that the applicant had provided a sufficient and reasonable explanation for the delay in filing the appeal, namely, that the appeal was initially filed within time but in the wrong court due to counsel's mistake. Upon discovering the error, the applicant withdrew the misfiled appeal and promptly filed the present application for enlargement of time. The court held that this conduct demonstrated diligence and a genuine intention to pursue the appeal, and that the mistake of counsel, once acknowledged and rectified without inordinate delay, constituted good and sufficient cause under section 79G of the Civil Procedure Act.
