Ratio Decidendi

The High Court found that the applicants' right to a fair trial had not been violated as they were ultimately supplied with all witness statements and had the opportunity to cross-examine witnesses, including the option to recall witnesses if necessary. The only issue properly before the court was the transfer of the criminal case for convenience. Given the elevation and transfer of previous magistrates, and the presence of a new magistrate at Kangundo Law Courts, it was more convenient and cost-effective for the case to be heard in Kangundo. The application was therefore allowed only to the extent of transferring the case to Kangundo Law Courts for further hearing and determination.
