The court held that, in light of the evolving jurisprudence on mandatory minimum sentences for sexual offences, particularly the directions in the Muruatetu and Philip Mueke Maingi cases, it is necessary to call for the applicant's trial and appellate records before exercising discretion on re-sentencing. The matter, having originated from a criminal trial in the Hamisi Principal Magistrate’s Court, should be transferred to the Vihiga High Court for further mention and directions. The court thus deferred substantive determination of the re-sentencing application pending receipt of the relevant records and transferred the matter to the appropriate jurisdiction.
